These Terms of Service govern your use of MindDeck, a mobile wellness companion app designed to support your mental health journey through personalized tools, journaling, and guided exercises. MindDeck is free, works fully offline, and has no account or subscription.

1. Acceptance of Terms

By downloading, installing, or using MindDeck, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree to these terms, you should not use the app.

• The app provides general wellness information, tools, and automated suggestions
• Content is not personalized medical advice, diagnosis, or treatment
• You assume full responsibility for any wellness decisions you make based on app content
• For serious mental health concerns, crisis situations, or professional guidance, consult licensed healthcare providers

Automated Recommendations Disclaimer

• Tool recommendations are generated by scoring on your device and are not a substitute for professional advice
• Recommendations are based on your survey answers and usage patterns, not individual clinical assessment
• You should evaluate suggestions critically and consult professionals for important decisions
• MindDeck does not guarantee the accuracy, completeness, or suitability of any suggestion

3. App Functionality & Services

Core Features (Free)

• Journaling Tools: Private note-taking and reflection features stored locally on your device
• Wellness Toolkit: Evidence-based mental health tools and strategies
• Progress Tracking: Personal mood and wellness pattern monitoring
• Crisis Resources: Emergency contact information and mental health support lines
• Offline Functionality: Most features work without internet connectivity

Everything Is Included

As of version 3.0.0 there is no paid tier. Every feature — personalized recommendations, mood analysis, journal insights, data export, and all wellness tools — is available to every user at no cost. There is nothing to purchase, subscribe to, or unlock.

4. User Responsibilities

Account & Usage

• You must be at least 18 years old to use MindDeck
• You are responsible for maintaining the confidentiality of your device and app access
• You agree to use the app only for lawful purposes and in compliance with these terms
• You are responsible for the accuracy of information you provide in surveys and journals

Mental Health Responsibility

• You acknowledge that mental health support should be provided by qualified professionals
• You agree to consult healthcare providers for any serious mental health concerns
• You understand that crisis resources available in-app are not real-time emergency services
• You are responsible for seeking immediate help for crisis situations (dial emergency services)

5. Privacy & Data

Data Storage

• All personal wellness data (journals, surveys, progress) is stored locally on your device
• Data backup and synchronization is your responsibility
• Uninstalling the app permanently removes all your stored data
• You can export your complete data history for personal backup, free

Data Encryption & Security

• MindDeck uses AES-256 encryption to protect sensitive wellness data stored on your device
• Encryption keys are managed through platform-secure storage systems (iOS Keychain/Android Keystore)
• All data encryption/decryption happens locally on your device
• We maintain a zero-knowledge policy - encrypted data cannot be accessed without your device
• Existing user data is automatically migrated to encrypted storage on app updates

External Services

• MindDeck requires no internet connection and communicates with no external service for its features
• Optional analytics and crash reporting use Firebase, and can be declined
• Optional analytics participation sends anonymous usage data only with explicit consent
• All external communications use industry-standard HTTPS encryption

6. Cost

MindDeck is free. There are no subscriptions, no in-app purchases, no advertising, and no payment information collected. Because nothing is sold, there is nothing to refund and no billing to cancel.

Users who purchased a subscription in a previous version lose nothing: every feature that was once paid is now available to everyone. No further action is required, and there is no subscription left to manage.

7. Intellectual Property

MindDeck Content

• MindDeck app, design, and core wellness content are protected by copyright
• You may not copy, modify, or distribute app content without permission
• Open-source wellness theories and tools are used with appropriate attribution

User-Generated Content

• Your journal entries and custom wellness content remain your intellectual property
• You retain ownership of all personal data and content you create
• By using the app, you grant MindDeck permission to process your data to provide services

8. Warranties & Limitation of Liability

"As Is" Service

• MindDeck is provided "as is" and "as available" without warranties of any kind
• We do not guarantee uninterrupted, error-free, or secure operation of the app
• Functionality may be affected by device capabilities, operating system updates, or connectivity issues
• We reserve the right to modify or discontinue features with reasonable notice

Limitation of Liability

• MindDeck shall not be liable for any indirect, incidental, special, or consequential damages
• Because MindDeck is provided free of charge, our total liability shall not exceed the amount you paid for the app, which is zero, in the 12 months preceding any claim
• You agree to indemnify MindDeck from claims arising from your use of the app

9. Termination

Account Termination

• You may stop using MindDeck at any time by uninstalling the app
• We reserve the right to terminate or restrict access to users violating these terms
• Termination does not relieve you of obligations incurred prior to termination
• Your data will be permanently deleted upon app uninstallation

10. Updates & Changes

App Updates

• MindDeck will periodically release updates to improve functionality and security
• Updates may modify existing features or introduce new ones
• Continued use of updated versions indicates acceptance of the new terms
• Features may change between versions, with reasonable notice

Terms Updates

We may update these terms occasionally. Users will be notified of significant changes through the app. Continued use after modifications indicates acceptance of updated terms.

11. Governing Law

These terms are governed by applicable laws and regulations. Any disputes arising from these terms shall be resolved through appropriate legal channels in the applicable jurisdiction.
